Judge orders release of three women from ICE custody

Three women detained during the June ICE raid at Omaha’s Glenn Valley Foods meatpacking plant have been ordered to be released.

Although an immigration judge granted them bond, ICE continued to detain the individuals due to an automatic stay that took effect when ICE filed its appeal.

In a decision on Thursday, U.S. District Court Judge Joseph Batallion reiterated that the automatic stay provision was unconstitutional.

Yurenia Genchi Palma, Nicandra Ozuna Carlon, and Filepa Lorenzo Perez are expected to be released from ICE custody today.

Their release comes after last week’s decision from the Board of Immigration Appeals that found the vast majority of undocumented immigrants are subject to mandatory detentions without a bond hearing regardless of how long they have lived in the U.S. or their community ties.
