The family of Vicente Manzo Hernandez is suing the City of Sioux City and officer Dyllon Frederickson for assault and battery.
In February Officer Frederickson pulled over a car in which Manzo Hernandez was the passenger. After realizing there was a warrant out for Manzo Hernandez, Frederickson attempted to apprehend him.
The situation intensified to where Officer Frederickson shot Manzo Hernandez, resulting in his death.
The lawsuit suggests Frederickson unnecessarily escalated the situation by aiming his firearm at both passengers and failing to disengage and used the situation to justify the use of deadly force.
Additionally, the document says there was no information provided indicating that Manoz Hernandez and the driver posed an immediate threat.
The lawsuit suggests the video from Frederickson’s bodycam had been edited, disproving his reason for shooting Manzo Hernandez.
Manzo Hernandez’s family is requesting a trial by jury.
