The South Dakota Legislature on Friday advanced a bill that prohibits distribution or advertisement of materials used for abortions.

Under the bill, providing abortion-inducing medications, drugs, or substances will be categorized as a class 6 felony.

According to the bill, people can face a penalty fee of up to $10,000 per violation and can be sued for the wrongful death of an unborn child.

The bill allows the state attorney general to take legal action to prevent or stop the unlawful action if they believe a person will, has, or is violating the clause.

The bill passed on a 10 to 2 vote and heads to the House floor next.
