Contractor and Subcontractor for Woodbury County Law Enforcement Center reach a settlement

The Woodbury County Law Enforcement Center building is show in October 2023 as construction continues towards a planned opening in spring 2024.

The general contractor, Hausmann Construction, and subcontractor, Leiber Construction, have settled their claims related to the Woodbury County Law Enforcement Center construction.

The two companies notified the court of the settlement Wednesday, as first reported by other news outlets.

Following the settlement, there are no pending trials, motions, or hearings.

Lieber initially sued Hausmann for over $150,000 for work completed. Hausmann filed a counterclaim saying that Lieber should be liable for $87,000 to cover the county’s cost to correct topsoil issues at the LEC.

Lieber filed its lawsuit in Woodbury County District Court in June, alleging breach of contract, claiming they were responsible for building a temporary construction road. However, a permanent road was built by another contractor, and Lieber said it was never asked to build a construction road.

Lieber stated Hausmann tried to lower the subcontractor’s payment by accounting for the potential cost of roads that were never constructed.

The lawsuit claims that Hausmann requested Leiber to carry out additional work, but Lieber did not complete it.

Hausmann argued that if found liable for damages, Leiber must compensate them for the $87,000 sought by the county to correct topsoil issues.

Hausmann also claimed design issues and omissions delayed their work and they were unfairly blamed. Hausmann also asserted that the county still owes them more than $5.7 million in unpaid work.

The original estimated cost of the building was $54 million, and it ended up costing $69 million.
