Judge in Tran Walker Trial Not Shown to Have Conflict of Interest

It’s been found that District Judge Tod Deck had no conflict of interest while presiding over Tran Walker's double-murder trial.   Walker's case will proceed to sentence, scheduled for Sept. 20 in Woodbury County District Court, according to the Sioux City Journal.  Walker was convicted for killing two companions.

A Woodbury County Public defender and First Assistant Woodbury County Attorney reviewed two juvenile court cases involving Walker and found nothing to show that Deck had any involvement in either case when he was a lawyer.  If so, they could have argued that Deck should have recused himself and sought his disqualification from the case. A disqualification could have led to a retrial.

Runoff into the Missouri River was once again above average in August, meaning releases from Gavins Point Dam and other reservoirs on the river will continue to be well above normal levels into late fall.

Releases from Gavins Point Dam near Yankton, South Dakota, remain at 70,000 cubic feet per second, nearly twice the average rate for this time of year and will remain at that level through September and possibly longer.

Iowa Governor Kim Reynolds today has been named Kelly Kennedy Garcia as the new director of the Iowa Department of Human Services.  Garcia is a Texas health and human services official.

Former DHS Director Jerry Foxhoven was ousted from the job in June for reasons Reynolds has not fully disclosed. Foxhoven claims it was because he questioned a pay arrangement for a staff member he thought might be illegal. He's filed a $2 million wrongful termination claim.
