A mistrial has been declared in a northeast Nebraska murder case.

Cuming County jurors had heard nine days of testimony surrounding the second-degree murder and other charges against Derek Olson. 

Prosecutors say Olson and his father, Jody Olson, killed 64-year-old Ernest Warnock more than 2-years ago, at Warnock's home in Rosalie.

The judge said the mistrial was warranted because a former Nebraska State Patrol investigator mentioned a lie detector test taken by Jody Olson. 

The judge says Jody Olson's testimony is key, so it's important that jurors not be swayed by the fact that a witness took and may have passed a test.

Jody Olson pleaded guilty to a charge of second-degree murder and agreed to testify against his son as part of a plea deal.

Derek Olson's second trial is scheduled to begin May 6.

Authorities say a man's body was found on a shore of the Floyd River near a college campus in northwest Iowa.

The body was spotted yesterday near the southeast portion of Northwest Iowa Community College property in Sheldon. It appeared the body had been underwater.

It was taken to a state laboratory in Ankeny for an autopsy. No name has been released yet.

The community of  Estherville, Iowa is dealing with major flooding according to the national weather service.  

There is a flood warning for the West Fork of the Des Moines River.  

The National Weather Service says at 3 this morning the river was at almost 15 feet. Or about 7 feet above flood stage.  

The Iowa House has passed a bill 96 to 3 that would make some changes to the state’s medical marijuana program.

The plan allows physician assistants and nurse practitioners to approve patients to seek a medical marijuana card. 

And it expands access to people with felony drug convictions, who are currently barred from the program, and to people with a terminal illness. 

The bill also removes the 3 percent cap on THC in medical marijuana products and instead limits patients to 25 grams of THC over 90 days. 

But it’s not yet clear how that new limit would apply to individual products, or if more potent oils, pills, and creams would be allowed. 

Coming up next on “The Exchange” hear from local law enforcement officers who don’t approve of expanding the medical marijuana program in the state.  We also talk to the manager of the Sioux City medical cannabis dispensary, who says easing restrictions would benefit patients who rely on the products.

Tonight’s Powerball jackpot has risen to $750 million dollars, the 4thlargest one in U.S. lottery history.

The Powerball jackpot has been growing since late December.

The winner will take home more than $465 after taxes.  The odds of winning are one in 292 million.

And, in sports, Iowa State and coach Steve Prohm have agreed to a three-year contract extension through the 2024-25 season.

The Cyclones announced the deal ending speculation that Prohm might leave for Alabama, his alma mater. 

Prohm has taken Iowa State to three NCAA Tournaments in four seasons since taking over for Fred Hoiberg. 

The Cyclones finished 23-12 this season, winning the Big 12 tournament for the second time under Prohm before losing to Ohio State in the NCAA Tournament on Friday.
