It appears likely that there will not be a Democrat on the November ballot for the U.S. Senate seat in Nebraska.
A Lancaster County judge this week ruled that the Nebraska Democratic Party does not have to fill a vacancy on the Senate ballot. That sets up a two-way race between incumbent Republican Pete Ricketts and independent candidate Dan Osborn for the Senate position
Cindy Burbank won the Democratic primary election in May, but then dropped out in July. Democrat William Forbes, who received about 10 percent of the vote in the primary, sued the Democratic Party over its decision not to fill the vacancy.
The Nebraska Democratic Party’s governing committee voted on August 23 to forgo filling the vacancy.
Forbes could appeal the decision to the Nebraska Supreme Court, but the statutory deadline for the party to fill a vacancy is Sept. 1.
Legal Marijuana Now Senate candidate Mike Marvin suspended his campaign last week and endorsed Osborn. Marvin’s name will still appear on the ballot, because he missed the deadline to remove it.
