Nebraska Supreme Court hears arguments over signatures

The Nebraska Supreme Court heard arguments on Wednesday over whether signatures on petitions to legalize medical marijuana were valid.

Former state senator John Kuehn argued the campaign behind Nebraskans for Medical Marijuana engaged in widespread fraud and misconduct.

Secretary of State Bob Evnen certified the petitions in September 2024.

Zachary Pohlman, an attorney representing Evnen, said they are not asking the court to throw out the petitions but to remand for a second phase of trial so the validity of signatures can be re-examined.

Justices questioned how the second phase would work if thousands of signers needed to testify promptly.

Pohlman said, “It would probably be sufficient to call some combination of circulators, notaries, and individual signers.”

Daniel Gutman, attorney for the petition sponsors, argued that Evnen already certified the medical marijuana petition and does not have standing to challenge it under the law.

Some justices have previously expressed skepticism about Evnen’s ability to change his mind about the validity of the petition signatures after he certified it.

There is no set timeline for the court to issue a decision.
