A jury was unable to reach a verdict in the first-degree murder trial of a man accused of killing a Native American woman more than 40 years ago in Sioux City.
Thomas Popp was accused of murdering Terri McCauley in 1983.
A grand jury indicted Popp last year. He was living in the state of Washington.
Since jurors said they couldn’t come up with a decision, the judge declared a mistrial. The county attorney has 90 days to decide if he will retry Popp for the crime.
McCauley’s nephew, Joshua Taylor, says he is hopeful Woodbury County Attorney James Loomis will pursue a new trial.
“We haven't lacked confidence in this county attorney's ability to move forward, and even more so now, I think the evidence that James presented is and was more than enough to render a guilty verdict," Taylor said.
